This privacy policy applies to RJC Evans & Co Pty Ltd (ABN 40 007 804 220), RJC Evans & Co Financial Planning Pty Ltd (ABN 90 347 410 649) and D G Murdock (ABN 69 322 370 663).  Any mention of ‘RJC Evans & Co’ throughout this policy includes all of the companies listed above.

RJC Evans & Co is committed to maintaining the privacy and confidentiality of personal information.  We understand and appreciate that you are concerned about the privacy of personal information that we may collect about you.

RJC Evans & Co will adhere to the Australian Privacy Principles (APPs) established under the Privacy Act 1988 when collecting, using, disclosing, securing and providing access to personal information.

Collection of Information

RJC Evans & Co collects personal information when it is necessary for business purposes and as part of our advisory role under our Australian Financial Services Licence (AFSL).  We may collect information from you for a number of purposes relating to our business dealings with you, such as:

  • Preparation of taxation, Centrelink and ASIC returns;
  • Provision of accounting, business, financial planning and risk management advice;
  • Completion of associated documents relating to the same;
  • Engagement of external advisors on your behalf; and
  • Marketing of services to you by ourselves or other suppliers which may be of interest to you unless you inform us not to do so.
  • Superannuation
  • Self-Managed Superannuation Fund (SMSF) advice under AFSL number 482656.

This information may include your name, address, telephone number, facsimile number, email address, employment history, tax file numbers and, in some cases, bank account details.

We collect most information directly from individuals when we deal with them.  The personal information we collect may be provided in forms filled out by individuals, face to face meetings, email messages, telephone conversations or by third parties.  If you contact us, we may keep a record of that contact.

RJC Evans & Co will only collect personal information once authorisation has been provided by you.  You have a right to refuse us authorisation to collection information from a third party.

In some cases we are required to collect the information to comply with legislation and various codes of conduct.

You are not obliged to provide us with the information requested, although in that event we may not be able to provide you with proper advice and service.

We will assume that the personal information that you provide to us is accurate, complete and up to date.  In the event that any of your personal information changes, please contact us as soon as possible and we will amend our records.

Where we collect information about you other than directly from you we will advise you of this fact and provide any other information to you about that collection as is determined relevant in the circumstances and in light of sub-clauses 5.1 and 5.2 of the APPs.

Use & Disclosure

RJC Evans & Co may collect individual personal information for the following main purposes:

  • To provide services;
  • To respond to requests made by individuals;
  • To maintain contact with clients;
  • To keep clients and other contact’s information of the services we offer and industry developments that may be of interest to them, and to notify them of services offered, seminars or other events being held;
  • For general management and reporting purposes, such as invoicing and account management;
  • For recruitment and employment purposes;
  • All other purposes that are related to our business.

Your personal information may be shared with one of RJC Evans & Co’s associated entities, for the purpose of providing the services detailed in the “Collection” section.  We may use the personal information for the purpose of providing you with direct marketing material, such as newsletters and articles that may be of interest to you.  You may, by contacting us, request not to receive such information and we will give effect to that request.

In providing services to you it may be necessary for us to disclose your personal information to others such as:

  • The Australian Taxation Office;
  • Other Government departments (including Centrelink and ASIC);
  • Financial Institutions;
  • The Securitor Group to assist in the provision of services to you; and
  • External service providers and auditors.

If we use or disclose your personal information we have gathered from you for the purpose of its collection (or any secondary purpose you have expressly consented to) we will advise you as soon as practicable.

Your personal information will not be disclosed to any overseas recipients unless you consent to the disclosure.

Storage & Security

We are committed to keeping secure the information which you provide to us and we will take all reasonable precautions to protect your personally identifiable information from loss, misuse or alteration.  At all times your personal information is treated as confidential and any sensitive information is treated as highly confidential.

Your personal information is generally held in your client file and also on our computer database.  Our security measures include:

  • All information stored on our computers is protected through password access to each computer;
  • Data is backed up daily and stored offsite;
  • Firewalls and virus protection software prevents hacking of our database;
  • Confidential security bins for the disposal of confidential information;
  • Clauses in employment contracts regarding confidentiality; and
  • Limited security access to our premises.

In the event that you cease to be a client of RJC Evans & Co, any personal information which we hold about you will be maintained in a secure storage facility for a period of seven years in order to comply with legislative requirements, following which time the information will be destroyed.  We will ensure that any documents are destroyed in a secure manner.

Access & Correction

We will provide access to personal information upon request by an individual, except in the limited circumstances in which it is permitted for us to withhold this information (for instance, where granted access would infringe another person’s privacy).

When you make a request to access personal information, we may require you to provide some form of identification (for example, drivers licence or passport) so we can verify that you are the person to whom the information relates.  In some cases, we may also request an administration fee to cover the cost of access.

We will do what we are able to ensure that your information is accurate and up to date.  We are happy to rectify any personal information we hold about you should you (or we) consider our records to be inaccurate.  Where you believe that personal information which we hold is not accurate, you may contact us and request correction.

Government Identifiers

In certain circumstances we are required to collect Government identifiers such as your tax file number, Medicare number or pension card number, we do not use or disclose this information other than when required or authorised by law or unless you have voluntarily consented to disclose this information to any third party.

Our Website

We provide several links to websites operated by third parties.  RJC Evans & Co is not responsible for the privacy practices or policies of those sites.  We encourage you to review each website’s privacy policy, especially if you intend to disclose any personal information via that site.  A link to another non-RJC Evans & Co website is not an express or implied endorsement, promotion or warranty of the products or services offered by or accessible through that site or advertised on that site.

While it is not necessary to register your personal details to use our website, we do offer a registration service that will enable you to receive product and service updates, newsletters and other information.  If you do register with us, we will collect personal information from you including your name and email address.

If you are registered and decide that you do not wish to receive any further information from us, or you wish to update your registration details, please contact our office.

If you have a complaint about a breach of the Australian Privacy Principles that binds R J C Evans & Co, you should contact our office directly using the details below to make the complaint and we will endeavour to respond as promptly as possible.  If you do not receive a response from our office after 30 days, or you are dissatisfied with the response, you may lodge a complaint to the Office of the Australian Information Commissioner (OAIC), they are accessible at www.oaic.gov.au
